Shipper Terms and Conditions
These Shipper Terms and Conditions ("Terms") govern the services provided by Secourier, LLC ("Carrier," "we," "us," or "our") to the shipper ("Shipper" or "you"). By tendering a shipment to the Carrier, you agree to these Terms.
1. Services
We provide freight transportation and logistics services as a motor carrier. All services are subject to these Terms, the Bill of Lading, and any other written agreements between us.
2. Bills of Lading
The Shipper shall provide a Bill of Lading that is accurate, legible, and complete. We will sign the Bill of Lading as a receipt for the goods and as a contract for carriage. The terms of our Bill of Lading shall supersede any conflicting terms on the Shipper's Bill of Lading.
3. Shipper's Responsibilities
The Shipper is responsible for:

Proper and accurate description of the goods.

Accurate weights, dimensions, and declared values.

Proper packaging, marking, and labeling of the goods.

Ensuring the goods are in a safe and secure condition for transportation.

Compliance with all applicable laws, rules, and regulations regarding the goods.
4. Rates and Payment

Rates: Rates are based on the information provided by the Shipper. We reserve the right to audit and adjust charges based on actual shipment characteristics.

Payment: Payment is due within the agreed-upon terms, typically 30 days from the invoice date. Late payments may be subject to interest charges.
5. Liability and Claims

Limitation of Liability: Our liability for loss, damage, or delay is limited as per our Bill of Lading and applicable law.

Claims: All claims for loss or damage must be filed in writing within a specified period (e.g., nine months) from the date of delivery or, in the case of non-delivery, from the date a reasonable time for delivery has elapsed. Failure to file a claim within this period constitutes a waiver of the claim.
6. Indemnity
The Shipper shall indemnify, defend, and hold harmless the Carrier from any claims, damages, or expenses arising from the Shipper's breach of these Terms, negligence, or willful misconduct.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan.
8. Entire Agreement
These Terms, along with the Bill of Lading, constitute the entire agreement between the parties regarding the services provided.
